1. Terms & Conditions

1.1 General

Thank you for accessing our website, www.heart-of-scotland.com (the “Site”). These Terms & Conditions apply to you (the user) while accessing our Site and its related channels. This Site is operated for the purpose of promoting alcoholic beverages.

The information contained on the Site may include views and opinions which, unless expressly stated otherwise, are not those of Heart of Scotland Distillery. Users access our Site at their own risk.

1.2 Acceptance of Use

Users of this Site are bound to the terms and conditions below. By accessing the Site, you confirm that you are:

  • Of legal age for purchasing and consuming alcoholic beverages in accordance with the regulations of your country of residence.
  • In a country which permits the promotion and consumption of alcoholic beverages.
  • Aware of how to consume alcohol responsibly.

1.3 User Behaviour

You agree to use the Site in accordance with the following conditions:

  • You may not act on behalf of Heart of Scotland Distillery or any affiliated groups/individuals.
  • You will not express opinions on the Site or related channels that are derogatory or otherwise offensive.
  • You will not infringe or disrupt the Site from functioning, expose it to viruses or spam, breach security, or conduct any illegal activity likely to violate the rights of Heart of Scotland Distillery.
  • You will refrain from sending content from the Site to persons under the legal alcohol consumption/purchasing age. 

Where relevant, we reserve the right (but not the obligation) to monitor use of the Site and remove any content which, in our sole discretion, may be offensive, illegal, questionable, or in breach of these terms and conditions.

1.4 Liability

To the maximum extent permitted by law, Heart of Scotland Distillery accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Site or any information contained therein. Users should be aware that they use the Site and its content at their own risk.

While every effort has been made to ensure these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977, if any term is found to be unlawful, invalid, or unenforceable, that term shall be deemed severed and shall not affect the validity and enforceability of the remaining terms.

Whilst we aim to ensure the content on the Site is correct, Heart of Scotland Distillery cannot give any warranty as to the accuracy or completeness of the Site. We cannot guarantee that the Site will operate error-free, uninterrupted, or free from computer viruses. The Site and its content are provided “as is”.

Heart of Scotland Distillery does not accept responsibility for any loss or damage you may encounter as a consequence of placing trust in information found on the Site. Appropriate research should be taken by the user before placing reliance upon content on the Site. Any reliance placed on information found on the Site is done at the user’s own risk.


2. Licensing Laws & Age Restriction

2.1 Licensing

As a company based in Scotland and shipping from Scotland, we are bound by Scottish licensing laws including Minimum Pricing and the Alcohol etc. (Scotland) Act 2010. These laws affect how we can legally run promotions and process refunds.

As part of these laws, we are limited to sales times between 10am and 10pm. Orders can be placed on our website at any time; however, they won’t be processed or delivered locally outside these hours of operation.

2.2 Age Restriction

As part of licensing law, we must restrict young people’s access to alcohol. In Scotland and the UK it is not permitted to sell or supply alcohol to a person under 18 years of age.

  • You may only purchase alcohol from us if you are at least 18 years old.
  • You may not purchase alcohol from us if it is intended for supply to someone under 18.
  • Where you are in the UK, or you direct us to deliver alcohol to a UK address, you warrant that the person taking delivery will be over 18.
  • If you are not in the UK (or the delivery address is outside the UK), you must check local regulations. By placing an order, you warrant that it is lawful for you to purchase and for us to supply alcohol to the delivery address/person.

If you breach these warranties, you will be liable for any costs we incur. We may also choose to end our contract with you and deduct any such cost from the account used to pay for your order.


3. Privacy

Privacy is important — not just for transactions, but also for the personal information you trust us with. For this reason, we take privacy and security seriously.

3.1 Information We Collect

To process a transaction, we require certain information, which will include at least your name, address, and payment details. Without this information, we can’t accept payment or dispatch orders.

With your express permission, we may occasionally send you offers or newsletters by email. We will never do this unless you sign up for it, and we won’t send spam.

3.2 Security of Your Data

To help keep information safe, your information is stored securely on encrypted servers by our hosting provider. Personal information provided on this website and online credit card transactions are transmitted through a secure server.

  • Emails and newsletters: You will receive promotional emails only if you have asked to receive them. You can unsubscribe using the link at the bottom of any email or contact social@heart-of-scotland.com. We use Mailchimp as our email service provider and gather statistics around opening and clicks using industry-standard technologies to monitor and improve our newsletters.   • Couriers and delivery companies: We use third party couriers and delivery companies including Royal Mail, Parcelforce, APC and DPD. To fulfil orders, we share necessary details such as your name, address, contact details and order details.
  • Online account registration: If you register an account, your details are stored securely so you don’t need to re-enter them for future orders. You can access your account to add, delete, or change information.
  • Trustpilot: We may use Trustpilot as a data processor when collecting reviews of our products and services. Your name, email address and details of items purchased may be shared if you agree to leave a review. Unsubscribe links are included in emails.
  • Google Analytics: We use Google Analytics to monitor visits and actions on our website. We may use analytical information for advertising activity. Please see Google’s privacy policy for more information.
  • E-commerce and online transactions: We use payment partners such as Stripe, PayPal and Apple Pay. These companies process transactions securely. We do not store credit or debit card details on our website. Users are encouraged to review payment partners’ Terms of Use and Privacy Policies.

While we strive to include quality, safe and relevant external links, users are advised to adopt caution before clicking external links. We cannot guarantee or verify the contents of externally linked websites. We adhere to good practices while using social media and expect staff to conduct themselves accordingly online. Users are advised to verify the authenticity of profiles before engaging with or sharing information. We will never ask for passwords or personal details on social media platforms.

4.6 Opt In / Out

If you are receiving marketing emails from us, it is because you signed up to our mailing list and agreed to receive marketing material from us. If you want to unsubscribe or opt out, click the unsubscribe link in our communications or contact social@heart-of-scotland.com. Where you opt out of marketing messages, you will still receive notification emails relating to orders placed.
